Cubano que desvió avión y lo trajo a EEUU filtra video

Un hombre que desvió un avión de Cuba hacia los Cayos de la Florida en el 2003 y recibió una larga condena, está pidiendo una revisión de su caso en un video no autorizado hecho desde la cárcel y que fue obtenido por Univisión 23.
En el video, Alexis Norniella Morales, de 44 años, denuncia presuntas “irregularidades” en su juicio, al que calificó de “sumario” y consideró “un escarmiento”. Justifica su decisión de filmar el video y hacerlo público –lo que contravendría las reglas de la prisión federal de Fort Dix en Nueva Jersey, donde cumple su condena– porque alega no haber tenido acceso a la prensa durante el juicio.
Norniella y otros cinco hombres desviaron un avión bimotor de hélice DC-3 de la empresa Aerotaxi –que cubría la ruta entre La Habana y la Isla de la Juventud– hasta Cayo Hueso el 19 de marzo del 2003. Catorce de los 37 pasajeros que iban a bordo decidieron quedarse en Estados Unidos.
El gobierno cubano permitió que el piloto, el copiloto, un mecánico y un asistente de vuelo testificaran para la fiscalía, pero no permitió la entrada al país de los abogados de la defensa para contactar a familiares y vecinos de los imputados. Los abogados no pudieron abandonar el aeropuerto cubano.
Por su parte, los miembros de la tripulación testificaron que Norniella y el resto de los acusados habían utilizado armas blancas para tomar el control del avión. La defensa alegó que todo era parte de un plan en el que miembros de la tripulación eran cómplices.
Después de un juicio que duró dos semanas en Cayo Hueso, Norniella –identificado como el líder del grupo–, y su hermano, Maikel Guerra Morales, fueron condenados a 24 años de privación de libertad bajo cargos de piratería aérea e interferencia con la tripulación. Un primo de ambos, Eduardo Javier Mejía Morales, y otros tres hombres, Yainer Olivares Samón, Neudis Infantes Hernández y Alvenis Arias Izquierdo, fueron sentenciados a 20 años cada uno.
El gobierno de EEUU pidió una condena a cadena perpetua para Norniella pero la Corte aceptó la petición de la defensa y ordenó la condena mínima en estos casos.

¿Vuelo a la libertad o piratería aérea?

“Fuimos encontrados culpables, algo que ni siquiera nos imaginábamos. Ni siquiera pensábamos que podíamos ser acusados, ir a juicio o que estábamos haciendo algo ilegal porque del 2003 hacia atrás, en 44 años, en casos similares o peores que el de nosotros, ninguno había ido preso en los Estados Unidos, ninguno había sido sentenciado, todos habían ido para la calle”, argumenta Norniella.
“¿Cómo iba a pensar que querer escapar de una dictadura me iba a traer estos problemas? [Fidel] Castro decía que nunca nadie iba preso”, agrega.
Una semana después en un incidente similar, otro avión de la misma ruta fue secuestrado y desviado hasta el aeropuerto de Cayo Hueso.
En el marco de las tensas relaciones políticas entre Estados Unidos y Cuba y bajo fuertes restricciones migratorias de ambas partes, desde 1959 y hasta el 2003, más de 50 aviones fueron secuestrados, la mayoría desviados hacia EEUU. Solo unos meses antes, en noviembre del 2002, el piloto de una avioneta utilizada para la fumigación recogió a familiares y desvió la nave hasta Cayo Hueso, Florida, sin mayores consecuencias legales, aunque en este caso no hubo uso de la fuerza. La aeronave fue decomisada por las autoridades norteamericanas y posteriormente subastada.
Como en los casos anteriores, Norniella y el resto de los acusados alegaron que era un “viaje hacia la libertad”, pero esta vez fueron juzgados como autores de un crimen.
“Este es un caso muy triste. Parece que el señor Norniella estaba simplemente tratando de escapar de la dictadura comunista en busca de libertad. Desafortunadamente, el momento no podía ser peor porque dos años antes las Torres Gemelas fueron derribadas por aviones secuestrados”, opinó la abogada cubanoamericana Silvia Pinera-Vázquez, especializada en casos criminales.

Escapando de la pobreza y la política

Norniella afirma que la Corte nunca consideró los precedentes de casos como el suyo. Tampoco su título universitario de Licenciado en Educación en la especialidad de Veterinaria y otros que, según destaca, muestran su intento de continuar superándose para obtener un trabajo.
Desde la cárcel, Norniella narra una vida de penurias económicas, desde su vida como maestro en un politécnico, donde ganaba $13 al mes, hasta su intento de encontrar trabajo en La Habana, adonde se mudó con la esperanza de mantener a su futura familia pues su esposa estaba embarazada. Norniella terminó vendiendo maní en la capital, de manera ilegal, pues su búsqueda de trabajo fracasó porque “no pertenecía a organizaciones políticas” y no era “comunista”.
“Los problemas económicos en Cuba son derivados de los problemas políticos”, reflexiona, antes de abundar en los problemas de salud de su hija y su experiencia con un deteriorado sistema de salud pública.
En la filmación, el condenado muestra un documento donde supuestamente consta que no tenía antecedentes criminales en Cuba. Una copia puede encontrarse en un sitio web con información sobre Norniella.
Pero las circunstancias personales de los acusados o el contexto político de Cuba no tuvo peso en la decisión del jurado –en el que no había ningún hispano– porque el juez federal de distrito James Lawrence King, que presidió el juicio, aceptó una moción presentada por los fiscales del gobierno, que impedía que Norniella y los otros imputados presentaran defensas basadas en la situación política o las condiciones de vida en Cuba.
En su decisión, el juez razonó que los ciudadanos de Cuba se encontraban en similares circunstancias pero no todos secuestraban aviones, lo que las leyes internacionales y la estadounidense consideran un acto criminal.
Una apelación presentada en el 2012 fue denegada porque Norniella no pudo convencer a la corte de que poseía nueva evidencia, de suficiente peso como para cuestionar su sentencia de culpabilidad. En esta ocasión, el cubano alegó que había sido mal defendido por su abogado porque este no le informó de un arreglo para rebajar su sentencia.

Perdón presidencial es improbable

Ahora Norniella está pidiendo al presidente Barack Obama un perdón presidencial y menciona el reciente intercambio de tres agentes de inteligencia cubanos relacionados con el derribo de dos avionetas de Hermanos al Rescate, en el que fallecieron cuatro personas.
“Un caso que tiene que ver con aviones y con muerte. Nosotros tenemos que ver con la libertad. ¿Por qué a ellos sí y a nosotros no?”, pregunta.
La hija de Norniella, ahora de 16 años, pidió directamente a Obama por el perdón de las condenas de su padre y su tío.
“Señor presidente, le pido desde el fondo de mi corazón... por favor, ellos son buenas personas, no hirieron a nadie, no mataron o violaron a nadie y se merecen estar libres. Solo cogieron el avión para venir a los Estados Unidos pero no recibieron esa libertad”, dijo Lisset, que reside actualmente en Miami y que vino en la aeronave con su padre cuando apenas tenía 4 años.
“Han pasado 12 años y mi abuela casi siempre llora, no ha podido ver a sus dos hijos. A mí también me ha perturbado. No poder tener a mi papá cuando estás creciendo, eso te deja una marca”, reflexiona.
Lisset no ha visto a Norniella en cinco años, pues no tiene los recursos económicos para visitarlo con frecuencia.
Llorando, la madre de los hermanos Alexis Norniella Morales y Maykel Guerra Morales, Cristina Morales, que reside en Cape Coral, todavía se pregunta “¿por qué no dejaron a los abogados hablar con los vecinos? La Isla de la Juventud completa iba a hablar de ellos, que eran buenos muchachos”.

Solo queda una vaga esperanza

Pero la abogada Pinera considera que un perdón presidencial es “muy improbable, porque 15 años después, este país todavía se horroriza cuando se menciona el 9 / 11 y estamos en medio de una crisis mundial con ISIS”.
En el video, el preso destaca también una incongruencia en las fechas de las actas de su primera declaración antes las autoridades de EEUU y la lectura de sus derechos al ser detenido. Los récords del caso indican que algunos de los testimonios de los acusados fueron desechados por ese motivo. Pero Pinera considera que, en cualquier caso, el jurado, contaba con evidencia suficiente para condenarlo.
“En este punto, Sr. Norniella parece haber agotado todas las vías regulares de apelación, explica la abogada, que menciona que la única “irregularidad” que pudo apreciar en el expediente del caso se relaciona con el asistente de vuelo que testificó en el juicio, Abilio Hernández García.
El tripulante escapó la vigilancia de los funcionarios cubanos que lo custodiaban y decidió permanecer en EEUU. “Esto podría haber apoyado la teoría de la defensa de que el avión no había sido tomado por la fuerza sino que era parte de un plan en el que los tripulantes eran cómplices”, señala.
Pero tras una breve investigación, los fiscales determinaron que Hernández no iba a cambiar su testimonio, tomado bajo juramento.
“El único destello de esperanza para el señor Norniella es encontrar a García y determinar si se quiere retractar de su testimonio, si esa es la verdad, y encontrar un modo de traer esto a una corte”, concluyó.
Hernández, que reside presuntamente en Las Vegas, no pudo ser contactado.

US Hijacker in Cuba Headed Home After 3 Decades

An American fugitive hijacker said Tuesday he is going home to face justice nearly three decades after he commandeered a plane, flew to Cuba and was thrown behind bars rather than greeted as a fellow revolutionary.
William Potts [photo] said U.S. diplomats in Havana contacted him earlier in the day to report that his travel arrangements were made and he could leave on a charter flight to Miami on Wednesday morning, accompanied by American officials.
"As I understand it when I land in Miami the federal escorts will turn me over to U.S. marshals, and what happens after that I couldn't tell you," Potts told The Associated Press by phone from his home in Havana. "I hope to be arraigned soon."
A spokeswoman for the U.S. Interests Section said the diplomatic mission did not have any immediate comment on Potts' case. Cuban officials did not immediately respond to a request for comment.
Potts, now 56, was a young man in 1984 when he pulled a gun hidden in a plaster cast and hijacked a commercial flight headed from New Jersey to Florida. He ordered it to the Communist-run island, where he expected that Cuba would offer him guerrilla training.
Instead, authorities convicted him of air piracy and jailed him for more than 13 years.
On Tuesday, Potts said he seeks "closure" by facing U.S. legal authorities. He argued that the time he served in the Combinado del Este prison outside Havana should mitigate further punishment in the United States, but acknowledged there's no guarantee.
"I'm ready for whatever," Potts said. "My position is, of course, I did the crime and I did the time, and the United States has to recognize that."
U.S. authorities have aggressively prosecuted some returning fugitives, while others saw their sentences reduced significantly for time served elsewhere.
Potts said he looks forward to reuniting with family he hasn't seen in many years, but is also anxious about returning from exile.
"I've got kind of mixed emotions, let me say that at least, about touching American soil for the first time in nearly 30 years," he said. "So much has changed, and I'm just going to have to wait and see what it looks like when I get there."
For years Potts has made his livelihood as a farmer in an eastern suburb of the Cuban capital. He married a Cuban woman with whom he had two children. They have since divorced, but remain close and live together in a modest two-bedroom home in a Cold War-era apartment block. Last year their two daughters went to live with family in Atlanta.
In recent weeks Potts has been working with U.S. Interests Section officials to get a passport to travel back to the United States. Nevertheless, he said his future remains in Havana.
"I'm a permanent resident in Cuba, and just as soon as I finish taking care of this business in the United States, I certainly have every intention of returning to Cuba to live," he said. "I'm here. ... I've lived like half my life here in Cuba now, and my future interests and the things that I want to do are located here in Cuba."

Open Letter To The President From American Muslim Hijacker

Apparently High officials in the Obama administration have targeted me and have decided to make me into a modern day Black Nathan Hale by refusing to issue me a one way passport that would allow me to return home to the U.S. after having completed a 15 year prison sentence in Cuba for hijacking. On March 27th 1984 I hijacked a North American airliner from New York to Havana Cuba. There I was taken into custody, tried in a Cuban court of law and sentenced to fifteen years in prison, all in accordance with the strict and specific stipulations of The Hague Convention For The Prevention Of Unlawful Seizure of Aircraft to which both the U.S. and Cuba are both signatories. Robert Patrick Richter, a white American, who also hijacked a plane to Cuba, in July 1983, was issued such a passport and a twin engine private plane was procured and the white American hijacker did in fact return to the United States in 1988 where he was sentenced to five additional years by U.S. District Judge William Zloch taking into consideration the time Richter had already spent in Cuban prison.

I have been in contact, since September of 2012, with the Asst. U. S. District Attorney’s office of Mr. Todd Mestepey and have made clear my sincere desire to return to the United States and face the charges against me. A Mr. Brent Brown, a U.S. federal officer I met with at the U.S. Interest Section here in Havana to discuss my imminent return to the U.S. informed me that he was awaiting instructions from Mr. Mestepey’s office to issue me a document, a one way passport, which would allow me to return directly to the United States. At that meeting Mr. Brown, to my surprise, treated me quite decently. He explained to me how, due to the outstanding federal warrants against me, I would formally be taken into federal custody and how the return would play out. Everything Mr. Brown explained was perfectly reasonable and completely acceptable to me. Over a year has passed however and I have yet to be issued this one way passport to travel back home to begin the judicial process, the only process by which this pending case of nearly thirty years can finally be brought to a close.

Questions and mysteries in the Cleveland kidnapping case

As former school-bus driver Ariel Castro was charged with kidnapping and rape on Wednesday, Cleveland police released disturbing new details about the torment three women say they suffered during years of imprisonment — from being chained up to beatings and abortions.
The allegations cleared up some of the questions surrounding the disappearance of Michelle Knight, Amanda Berry and Gina DeJesus, who were reunited with their families after Berry escaped from the house with her 6-year-old daughter.
Many questions remain unanswered but here's a look at what we know:
Why were there no witnesses to the kidnappings?
The police report says Ariel Castro abducted all three women simply by offering each of them a ride. He allegedly told Berry, who had just left her job at Burger King, that his son also worked there. He allegedly told DeJesus he would give her a ride to his house so she could hang out with his daughter, who attended the same school.
Why weren't they able to escape for so many years?
The women told investigators they were initially kept chained in the basement, then barricaded on the second floor of the home. The doors were kept locked except when Castro would leave one unlocked to test the women, the police report said.
How is it possible no one knew three women were being held captive in the house for about a decade?
Authorities said Ariel Castro took great pains to keep the women inside the house. They could only recall two occasions when they were allowed outside, and then not off the property.
Also, relatives have said Castro never invited anyone over, and Deputy Chief Ed Tomba said, "Ariel kept everyone at a distance."
A few neighbors have claimed they saw a woman at a window or witnessed naked women on leashes in the yard and called police, but authorities said Wednesday there is no record of such calls and no evidence the incidents happened.
Why were Castro's brothers arrested but not charged?
Onil Castro was in a car with Ariel Castro when police swooped down on them in a McDonald's parking lot after Berry's escape. Onil asked police if they were looking for their brother, Pedro — who was then found passed out in his mother's backyard, according to the police report.
Officials confirm that Cleveland police were at the home where three women were held only once, in 2004, on a non-related call; that the women were outside very briefly twice; and that neither of Ariel Castro's brothers knew anything about the women in his home.
"It was an investigative stop," Tomba said, adding that police had probable cause to detain the brothers.
After investigators spoke to Ariel Castro and the victims, however, they determined there was "no evidence" they knew about or took part in the abductions.
What might other members of the Castro family have known?
Relatives say they knew nothing about the kidnappings, although two of Castro's children had coincidental ties to the case. Ariel's 31-year-old son, who goes by the first name Anthony, wrote a story about DeJesus' and Berry's disappearances in a local newspaper in 2004 when he was a journalism student and told the Cleveland Plain Dealer it was "unspeakable" to learn his father was allegedly behind it.
And Ariel's daughter Arlene, who now lives in Indiana, was described as DeJesus' best friend in a 2004 "America's Most Wanted" segment. She told the TV show that they left school together that fateful day but parted ways when her mother wouldn't give her permission to go to the DeJesus home. 
Is Ariel Castro the father of Amanda Berry's daughter?
Police said they have obtained DNA from Castro and will conduct a paternity test. The three women say they were raped by Castro, and that he forced Knight to abort five pregnancies. Knight said he made her deliver Berry's baby in a kiddie pool, threatening to kill Knight if the child died, the police report said. 
Were there other women?

Officials have said they have no reason to believe Castro will be a suspect in other disappearances. No human remains were found on the property, they said.
Several other women remain missing in Cleveland, including: Ashley Summers, who was 14 when she vanished in July 2007; Christina Kleckner, who was 24 at the time when she was last seen in October 2011; and Christina Adkins, who was 18 and pregnant when she was last seen in 1995.
Police were hoping for a break in the Summers case — "Her disappearance was part of our questioning," Tomba said — but didn't get one.
Did the police drop the ball?
Several neighbors claim they called police about disturbing goings-on at the Castro house -- from a woman with a baby trying to get out to women on leashes in the yard -- and one even said cops responded and pounded on the door in 2011.
But authorities are adamant: They were only summoned to the house twice, once in 2000 by Ariel Castro himself, complaining about a fight on the street, and in 2004 when they needed to question him about a child left behind on his school bus. In the latter case, no one answered the door and they were able to find Castro elsewhere.
Officials said the women denied ever being leashed-up in the yard.
Will anyone collect a reward?
A $25,000 reward for Amanda Berry's whereabouts had been offered at one point, but it was unclear if it's valid or who would get it.
The most likely recipient would be Charles "Chuck" Ramsey, who heard Berry's screams on Monday and helped kick down the storm door so she and her child could escape.
Ramsey, a dishwasher who became a social-media sensation after telling his story in TV interviews, has said any reward money should go to the victims.
What's next for Castro?
Police said he waived the reading of his Miranda rights and has spoken to them. It's unclear if he has retained an attorney. He is due to be arraigned on kidnapping and rape charges Thursday at 8 a.m. ET

Two days after three women missing at least a decade were freed from a home in downtown Cleveland, details about the victims and the suspects are starting emerge.
Police say Amanda Berry, Gina DeJesus and Michelle Knight were all held captive in a home owned by local musician and bus driver Ariel Castro and his brothers.
The Cleveland Police Department released the audio of the 911 call made my Charles Ramsey after discovering the Ohio women who had been missing for over a decade.
Neighbors said they had no idea anyone else was inside Castro’s home on Seymour Avenue. They only knew him as a “nice guy” who liked to attend barbecues, listen to Spanish music and ride a four-wheeler.
But police say his home was a prison, where the three women were tied down in order to keep from escaping.
Here is a guide the victims and suspects in the case, and what we know (and don’t know) about them. 
THE VICTIMS
Amanda Berry: As a 17-year-old, Berry worked a part-time job at a Burger King. But she left work on April 21, 2003 and never came back. Her mother, the late Louwana Miller, told the Plain Dealer newspaper the next month that she kept Amanda’s bed as it was, and left clean laundry for her stacked on the dresser. The following year, Berry’s case was featured on “America’s Most Wanted.” The mother went on Montel Williams’ talk show, where a self-proclaimed psychic told her that her daughter was probably dead, NBC affiliate WKYC reported. Berry gave birth six years ago in captivity. It was not clear who the father was. On Monday night, a neighbor, Charles Ramsey, spotted Berry kicking the door and screaming: “I’ve been in this house a long time, and I want to leave right now!” Berry called 911, pleading with the dispatcher to send a police car immediately: “I’m Amanda Berry. I’ve been on the news for the last 10 years.”
Gina DeJesus: DeJesus was 14, in seventh grade, when she left school April 2, 2004 to walk home one day and vanished. Her first name is short for Georgina. A website set up to spread word of her disappearance said she had pierced ears — one in the left ear, two in the right. In April, DeJesus’ family held a rally to mark the ninth anniversary of her disappearance. Her mother, Nancy Ruiz, said at the time that she was certain her daughter was alive. On Tuesday, a giant “WELCOME HOME GINA” banner hung from the family’s house, and a growing cluster of brightly colored helium balloons decorated the front of the home. Someone strung her missing-poster photo between the front stoop and the mailbox. DeJesus is now 23.
Michelle Knight: Knight was 21 when she disappeared — the oldest of the kidnapping victims and by far the least known. She was last seen at a cousin’s house on Aug. 22, 2002, not far from where Berry and DeJesus were last seen. Her grandmother, Barbara Knight, told the newspaper that she never believed her granddaughter would disappear without so much as a phone call. But she said family members concluded, based on conversations with police and social workers, that Knight probably ran away because she was angry that her son had been removed from her custody. Knight is 32 today.
Berry's six-year old daughter: Police say Amanda Berry gave birth to a child while in captivity. Chuck Ramsey, a neighbor who helped rescue Berry, said a little girl came out of Castro's home with her. It was unclear who is the father. She has not been named.

THE SUSPECTS
Ariel Castro: A 52-year-old former school bus driver and bass guitar player who sometimes played in a local merengue band, he lived on Seymour Avenue in downtown Cleveland where police say he held three women captive for a decade by tying them up. He was arrested on Monday after Amanda Berry kicked through the bottom of a door and escaped. Two other missing women, Gina DeJesus and Michelle Knight, were discovered at his home. In 2005, he was accused in a court filing of attacking his former wife Grimilda Figueroa, the Plain Dealer reported. Her lawyer at the time requested that a judge keep him from threatening to kill her, and also said that though Figueroa had full custody with no visitation for Castro, he "frequently abducts daughters and keeps them from mother,’’ the newspaper reported. Nine years ago, police went to Ariel’s home to investigate a child left behind on a bus, but did not charge him. He was fired in November from his bus driver's job after 22 years, the Plain Dealer reported. A post on Ariel Castro's Facebook page says he is the grandfather to five children – four boys and a girl. Castro, along with an older and younger brother, are in jail pending formal charges.
Onil Castro: At 50, he is the youngest of the three brothers who grew up around their father's used car lot in Cleveland's west end. Nelson Roman, a family friend, told the Plain Dealer that Onil was a heavy drinker who had worked as a handyman but stopped working years ago. He was not married. After his arrest, he was taken to the Cleveland jail.
Pedro Castro: The older brother of Ariel Castro, 54-year-old Pedro Castro lived on the west side of Cleveland, according to police. A family friend told the Plain Dealer that Pedro became involved in alcohol at a young age and dropped out of high school despite being a straight-A student. He had worked as a factory worker in past years but stopped because of his drinking, Nelson Roman said. He was not married. When investigators dug in an empty lot for Amanda Berry last year at a time she was presumed dead, a Pedro Castro told a local Fox affiliate the search was “a waste of money.” It was unclear, however, if the Pedro Castro interviewed is the suspect. He is also in the jail while a grand jury considers charges.

It is now also holding a young American filmmaker, Timothy Tracy, hostage through its puppet-government in Venezuela.

U.S. diplomats have been given no access to a California man held in Venezuela for nearly two weeks in what his family on Monday called a “nightmare” that unfolded after he was accused of being a spy fomenting post-election unrest.

The family of Timothy Tracy, 35, told The Associated Press in a statement that “we hope that he is granted consular access very soon.”

U.S. President Barack Obama has said that the accusations against Tracy are “ridiculous.”

Cuba to turn over Florida couple and children

HAVANA Cuba said Tuesday that it will turn over to the United States a Florida couple who allegedly kidnapped their own children from the mother's parents and fled by boat to Havana, ending days of drama that recalled the Elian Gonzalez custody battle of more than a decade ago.
Foreign Ministry official Johana Tablada told The Associated Press in a written statement Tuesday that Cuba had informed U.S. authorities of the country's decision to turn over Joshua Michael Hakken, his wife Sharyn, and their two young boys.
She did not say when the handover would occur, but reporters saw Sharyn Hakken leaving the dock of Havana's Hemingway Marina in the back seat of a Cuban government vehicle and workers later said that all four Hakkens had been taken away.
An AP reporter spotted the family earlier Tuesday beside their boat at the marina. A man who resembled photographs of Joshua Michael Hakken yelled out "Stop! Stay back!" as the reporter approached, but there was no outward sign of tension or distress between the family members.
Tablada said the Foreign Ministry had informed U.S. diplomats on the island "of the Cuban government's willingness to turn over ... U.S. citizens Joshua Michael Hakken, his wife Sharyn Patricia and their two minor sons."
She said Cuba tipped the State Department off to the Hakkens' presence on Sunday and that from that moment "diplomatic contact has been exchanged and a professional and constant communication has been maintained."
U.S. authorities say Hakken kidnapped his sons, 4-year-old Cole and 2-year-old Chase, from his mother-in-law's house north of Tampa. The boys' maternal grandparents had been granted permanent custody of the boys last week.
The U.S. and Cuba share no extradition agreement and the island nation is also not a signatory of the Hague Convention on the Civil Aspects of International Child Abduction, an international treaty for governmental cooperation on such cases.
Cuba has harbored U.S. fugitives in the past, though most of those cases date back to the 1960s and 70s, when the island became a refuge for members of the Black Panthers and other militant groups. More recently, dozens of Cuban Medicare fraud fugitives in the U.S. have tried to escape prosecution by returning to the island.
But Cuba has also cooperated with U.S. authorities in returning several criminal fugitives in recent years.
Hakken lost custody of his sons last year after a drug possession arrest in Louisiana and later tried to take the children from a foster home at gunpoint, authorities said. A warrant has been issued for his arrest on two counts of kidnapping; interference with child custody; child neglect; false imprisonment and other charges.
According to the Hillsborough County Sheriff's Office, Hakken entered his mother-in-law's Florida house last Wednesday, tied her up and fled with his sons. Federal, state and local authorities searched by air and sea for a boat Hakken had recently bought. The truck Hakken, his wife and the boys had been traveling in was found Thursday, abandoned in Madeira Beach, Florida.
"He'll have to face in Hillsborough county the charges he has with the sheriff's office," spokeswoman Cristal Bermudez Nunez Nunez said. She said she did not know how the family would be returned or what will happen when they arrive on U.S. soil.
Terri Durdaller, a spokeswoman at the Florida Department of Children and Families, said it was not clear where the children will ultimately be placed.
"Louisiana is the ultimate decision maker on where these children will reside. It's likely they will be placed back in Florida with the grandmother," she said.
The Hakkens' flight to Cuba recalls the child custody case that set Cold War foes Washington and Havana feuding in 1999. That year, 5-year-old Elian Gonzalez was found clinging to an inner tube off Florida after his mother and others drowned while fleeing Cuba toward American soil. The boy was taken to Miami to live with relatives, but his father in Cuba demanded the boy be sent back.
U.S. courts ultimately ruled Gonzalez should be sent back, though his Miami relatives refused to return him. In April 2000, U.S. federal agents raided the family's home and he was returned to Cuba soon after. He has since grown into a young man and joined a military academy.
At the Havana marina on Tuesday, the family showed no sign they knew a decision about their fate had been made. The four strolled by an outdoor restaurant as security officials kept reporters at a distance.
The youngest child was seated in a stroller and the elder boy sat down on a curb. A woman who resembled Sharyn Hakken was seen on the boat.
Cuban officials told reporters not to take pictures of the family or the boat, which bore the name Salty and had a paw print on its side.
Andrew Zych, a Canadian docked in a sailboat steps away from the Hakkens, said the family had arrived recently and seemed normal.
"I liked the way they played with the kids," he said, adding he was surprised to learn of events in the U.S.

Hakken family & kipnapped kids located in Cuban marina

Havana, Cuba (CNN) -- The smallest boat moored at the Hemingway Marina in Havana may hold the most intrigue.
Hunkered down inside a blue, 25-foot sailboat named Salty are Josh Hakken and his wife, Sharyn, and their two boys, 2-year-old Chase and 4-year-old Cole.
Theirs is no ordinary visit to the historic port, where they have eluded capture but where CNN found them Tuesday. The Hakkens have been on the lam after they allegedly snatched the two boys from their grandmother's home in Florida.
The couple lost custody of their children last year. There is an international manhunt for this family, and here they are, blending in among the other boats.
But their stop appears likely to be temporary, as Cuban officials announced Tuesday afternoon that they plan to turn the family over to U.S. authorities.
Josh Hakken glared through his sunglasses at the CNN reporter who found him and said nothing beyond confirming his identity.
The two boys are OK, said a woman matching the description of his wife, and she left it at that.
Josh and Sharyn Hakken are wanted by U.S. authorities and were not in custody in Cuba. But that doesn't mean they aren't being watched.
Cuban security officials wearing sidearms appeared as the CNN video crew was filming and ordered them to stop. At the security guards' request, CNN stepped away from the boat, which looked just like the photo that Florida law enforcement officials had circulated, except more battered.
U.S. government officials have told the sheriff's office in Hillsborough County, Florida -- which includes the city of Tampa from which the boys went missing -- that "they are receiving exceptional cooperation from the Cuban government," the sheriff's office said Tuesday afternoon.
Earlier in the day, U.S. State Department spokesman Patrick Ventrell said the State Department is aware of the case, though it could not provide additional information because of privacy concerns.
"But what I do want to say, more broadly speaking, is that one of the department's highest priorities is the welfare of U.S. citizens overseas, and this is particularly true for children who are our most vulnerable citizens," Ventrell said.
Some worried that recovering the children will be difficult.
"Unfortunately, these parents and these poor children, these innocent ones, will now be in a country where there are no laws, there is no redress, and that has been a refuge for fugitives and wanted criminals for many years," Rep. Ileana Ros-Lehtinen, R- Florida, told CNN.
The boys had been removed from the care of the Florida couple last year, and on April 2, the couple's parental rights were terminated in Louisiana, investigators say.
The Hillsborough County sheriff's office described Josh Hakken as an anti-government protester, and he was believed to be armed, according to the Hillsborough County sheriff's office.
There is no extradition treaty between Cuba and the United States, although there have been recent cases in which Americans sought for crimes in the United States and discovered in Havana have been sent back by the Cubans.
The FBI currently estimates there are around 70 fugitives from U.S. justice in Cuba, which is one of the reasons Cuba remains on the U.S. list of countries that support state terrorism. Most of the American fugitives in Cuba have been there for decades and have ties to revolutionary movements or radical groups.
Last week, the police department in Slidell, Louisiana, issued its own statement offering background on the Hakkens and why the boys were taken from the parents last year.
In June of 2012, Slidell police responded to a disturbance report at a hotel where Josh and Sharyn Hakken were staying with their sons, the police statement said.
"When police arrived, both Mr. and Mrs. Hakken were acting in a bizarre manner that alarmed officers. They were talking about 'completing their ultimate journey' and were traveling across the country to 'take a journey to the Armageddon'," the Slidell police statement said, adding, "Let it be noted that both of their children were present in the hotel room at the time."
Because of the parents' behavior and "the fact that narcotics and weapons were located inside of the hotel room," the children were taken by child welfare officers, and Joshua Hakken was arrested on drug charges, the statement said.
"Approximately two weeks later, Slidell Police were notified that Mr. Hakken had shown up to the foster family home ... with a firearm demanding the return of his children," the Slidell police statement continued. "The foster parents called 911, and Mr. Hakken fled without his children. We have heard nothing until (Wednesday)."
At some point over the past few months, the children were sent to live with their grandmother, Patricia Hauser, the mother of Sharyn Hakken.
Sheriff's investigators say Josh Hakken entered Hauser's home at 6:30 a.m. last Wednesday. She told police that he tied her up and fled with the children in her silver 2009 Toyota Camry. That vehicle was found later that day just a couple of blocks away from the home.
Those investigators told CNN they believe Hakken joined up with his wife, who was waiting in their pickup truck, and the family drove to a parking garage. A short time later, investigators said, Hakken is believed to have taken a sailboat out of a private slip in nearby Madeira Beach.
Surveillance images showed the boat sailing into the Gulf of Mexico about three and a half hours after the boys disappeared from their grandmother's home, investigators said, adding that the photos showed adults and children on board.

A Florida couple suspected of kidnapping their two sons from the woman's parents in Tampa have fled by boat to Cuba, according to Florida authorities.
The boys had been living since last year with their maternal grandparents, who were granted permanent custody a week ago.
The Hillsborough County Sheriff's Office alleges that Joshua Michael Hakken entered his mother-in-law's house north of Tampa on Wednesday, tied her up and fled with his sons, 4-year-old Cole and 2-year-old Chase.
The Hillsborough Sheriff's office has issued an arrest warrant for Hakken on charges of kidnapping and several other counts.


He lost custody of his sons last year after a drug possession arrest in Louisiana, and he later tried to take them from a foster home at gunpoint, authorities have said. Authorities have previously characterized the Hakkens as "anti-government." The sheriff's office says it has received information that the Hakken family had arrived in Cuba. Investigators say they're working with the FBI and the U.S. State Department to verify their reports. CNN's Patrick Oppmann, reporting from Havana, reported that he had seen the family at a Marina, but they refused to talk to him. Cuba does not have an extradition treaty with the United States.

The U.S. Interest Section in Cuba released its own statement, saying it is aware of this case and it's in contact with local authorities.
"U.S. officials are providing all appropriate assistance to the family," the statement said. "Because of privacy reasons, we are unable to provide any additional information. One of the Department's highest priorities is the welfare of U.S. citizens overseas. This is particularly true for children, who are our most vulnerable citizens. The Department works with parents and foreign governments to resolve these difficult cases."
Detectives suspect Hakken, an experienced sailor, had drawn up an elaborate getaway plan, buying a boat a few weeks ago that can accommodate four people comfortably, WTSP-TV reported..
A truck that Hakken, his wife Sharyn and the boys had been traveling in was found late Thursday, abandoned in a parking garage in Madeira Beach. Authorities say they had been searching the entire Gulf coast from Pensacola to the Keys and the Intracoastal Waterway. An Amber Alert for the boys was also issued in Florida, Louisiana and other states.
